Shameful Realities, Facts As Nigerian Court Dismisses Application To Extradite Abba Kyari To The US For His Fraud Trial!
The Federal High Court in Abuja, Nigeria, has reportedly thrown out the federal government of Nigeria’s suit to extradite the embattled and disgraced Deputy Commissioner of Police, Abba Kyari, to the United States of America to face trial on fraud charges.
Passing the judgment on August 29, 2022, Justice Inyang Ekwo said that the federal government’s request, which was filed by the Attorney General of the Federation (AGF), “lacked merit and was liable to dismissal.”
Recall that DCP Kyari is wanted in the US for conspiracy to commit wire fraud, money laundering, and identity theft. A grand jury had filed an indictment against him with the approval of the US District Court for the Central District of California, and a warrant for his arrest was issued on April 29, 2021.
However, in his recent judgment, Justice Ekwo held that the government had no basis for filing the extradition request because it had put Kyari on trial in Nigeria in relation to the allegations against him in the US.
Describing the government’s extradition request as “strange, incompetent and bereft of merit,” the judge said: “Malami, being the Chief Law Officer of the country, ought to be aware that the Extradition Act forbids the surrendering of a defendant that is already facing trial before a competent court in the country.
The AGF could not say that he was not aware of the pending proceedings against the defendant which was entered against him by the NDLEA.”
Justice Ekwo further said that it is clearly stated in the Nigerian Constitution that, having been put on trial before a court of competent jurisdiction in the country, DCP Kyari “shall not be surrendered until such a case has been discharged either by his conviction or acquittal.”
Having been the one who allegedly instituted the National Drug Law Enforcement Agency (NDLEA) case to prosecute Kyari on drug-related charges, the judge openly queried why the AGF still approached it with the extradition application.
Speaking after the judgment, the AGF’s Special Assistant on Media and Public Relations, Dr. Umar Gwandu, said: “The Federal Government will study the judgment and decide the next line of action within the provisions of the law.”
According to reports, the US Department of Justice (DOJ) has disclosed that it would not comment on the matter until DCP Kyari is successfully extradited.
The DOJ’s spokesperson, Nicole Oxman, reportedly disclosed: “As a matter of policy, the US Department of Justice generally does not comment on extradition-related matters until a defendant is in the United States.”
There is truly nothing much to say or point out about this matter besides what we believe is already pretty obvious, and annoyingly so, too!
This Muhammadu Buhari and the APC-led federal government has and may forever be the most vilely and brazenly corrupt administration in the entire history of Nigeria! However, what’s more annoying is the fact that these charlatans actually think Nigerians are some dim-witted fools like them, too.
For crying out loud, how in God’s holy name can a country’s AGF claim not to know these basic technicalities upon which DCP Kyari is boldly being protected and covered as their cabal’s loyal, faithful, and long-serving servant? Is this not tantamount to madness?!
This country has not only been ruined economically but it has also been sadly wrecked in many other alarming ways by this evil and shockingly corrupt administration! And, to think that the major bargaining chip that won them the elections in 2015 was a promise to “fight and totally eradicate corruption!”
The joke is on every average Nigerian right now, but it would be so much worse if, for any reason, the wrong choices are again made during the forthcoming general elections in 2023.
